Student Lettings Law and HMO Licensing in Wales

Student letting in Wales comes with specific regulatory considerations. Properties let to three or more unrelated students sharing facilities typically constitute a House in Multiple Occupation (HMO) under the Housing Act 2004. HMOs in Wales require a mandatory licence from the relevant local authority where they have 5 or more occupants. Many Welsh councils have introduced additional licensing schemes extending licensing requirements to smaller HMOs. Cardiff, Swansea, Newport and Ceredigion (Aberystwyth) all operate additional licensing schemes that require landlords to licence HMOs of any size where three or more unrelated occupants share facilities. The Renting Homes (Wales) Act 2016 applies fully to student lettings — occupation contracts must be issued, the FFHH standard must be maintained, and the Rent Smart Wales licensing requirement applies. Guarantor arrangements must be properly documented to be enforceable.

Under the Renting Homes (Wales) Act 2016, student lets use the Standard Occupation Contract, which replaces the AST. For shared student properties, all occupants are named on the contract and have joint and several liability — meaning each is responsible for the full rent if others do not pay. Written statements must be served within 14 days. Fixed-term contracts are standard for student lets, typically running for 12 months from July or August.

Most student occupation contracts are guaranteed by parents or other suitable persons. The guarantor agreement must be properly drafted, executed as a deed (with a witness) and ideally provided before the occupation contract is signed. Guarantors have joint and several liability for the contract-holder's obligations. We reference guarantors through the same process as tenants to confirm their suitability.

Many student contracts run from July/August to July/August, which minimises summer voids — the property is committed for the academic year and into the following one. Where summer voids exist, we market proactively from February/March for the following academic year, targeting returning student groups.
