What Every Welsh Landlord Must Comply With

Being a landlord in Wales is a regulated activity. The Housing (Wales) Act 2014 requires every landlord who rents property in Wales to register with Rent Smart Wales, and either obtain a licence (if self-managing) or appoint a licensed agent. The Renting Homes (Wales) Act 2016 imposes the Fitness for Human Habitation standard, mandatory written occupation contracts, extended notice periods and specific requirements around safety. Safety requirements include annual gas safety checks (CP12), periodic electrical installation condition reports (EICR at least every 5 years), current Energy Performance Certificates (EPC) and working smoke alarms and carbon monoxide detectors. The Anti-Money Laundering regime requires landlords to conduct customer due diligence on tenants in certain circumstances. Non-compliance can result in criminal prosecution, unlimited fines, rent repayment orders and inability to serve valid possession notices.

Rent Smart Wales is the registration and licensing scheme for landlords and letting agents in Wales under the Housing (Wales) Act 2014. Every landlord who rents residential property in Wales must register with Rent Smart Wales, regardless of whether they use an agent. Landlords who manage their own properties must also obtain a licence. Failure to register or licence is a criminal offence carrying an unlimited fine.

Welsh landlords must provide: a valid Gas Safety Certificate (CP12) renewed annually if there is a gas supply; an Electrical Installation Condition Report (EICR) at least every 5 years; a current Energy Performance Certificate (EPC) rated E or above; working smoke alarms on every floor; and carbon monoxide detectors in rooms with solid fuel appliances or where required. Additional requirements apply to HMOs.

The FFHH standard under the Renting Homes (Wales) Act 2016 is a positive obligation on landlords to ensure properties are fit for human habitation at all times — not just at the start of the tenancy. It covers 29 categories of hazard. If a property falls below the standard, the contract-holder can apply to court for remediation without needing to rely on disrepair or covenant obligations.

Non-compliance carries serious consequences. Operating without Rent Smart Wales registration or licensing is a criminal offence with unlimited fines. Failure to provide a written occupation contract delays your ability to serve a no-fault possession notice. Missing safety certificates can invalidate possession proceedings and expose you to rent repayment orders of up to 12 months' rent.

If you use a Rent Smart Wales licensed agent to carry out all management activities on your behalf, you do not need a landlord licence yourself — but you do still need to be registered with Rent Smart Wales. Registration and licensing are separate requirements.
