Landlords must comply with Housing (Wales) Act 2014 and various safety regulations:

🏠 What is an Occupation Contract?

 

Under the Renting Homes (Wales) Act 2016, which came into effect on 1 December 2022, all rental agreements in Wales are now standardised as Occupation Contracts. This simplifies renting by replacing previous tenancy types, including Assured Shorthold Tenancies (ASTs).

Key Features of an Occupation Contract:

  • The landlord is now called the Community Landlord or Private Landlord.
  • The tenant or licensee is referred to as the Contract-Holder.
  • All tenancy agreements are replaced by a single, written contract, known as the Occupation Contract.
  • It provides clear terms regarding rent, maintenance responsibilities, and notice periods.

 

Ending an Occupation Contract

To end an Occupation Contract:

  1. Landlord’s Notice (No Fault Possession):

    • A landlord must give a minimum of 6 months’ notice under a no-fault notice (previously Section 21), provided the contract is outside the fixed term.
    • The landlord cannot issue a no-fault notice within the first 6 months of the contract.
  2. Tenant’s Notice:

    • The contract-holder (tenant) must provide at least 1 month’s written notice, unless otherwise stated in the contract.
  3. Possession for Rent Arrears or Breach of Contract:

    • If the contract-holder falls into 2+ months of rent arrears, the landlord can seek possession through the courts under a breach of contract.

 

Other Key Rights and Responsibilities:

  • Repairs & Maintenance: Landlords are responsible for ensuring the property is safe, fit for human habitation, and maintained throughout the tenancy.
  • Deposit Protection: Any security deposit must be registered with a government-approved tenancy deposit scheme.
  • Safety Compliance: Landlords must provide Gas Safety Certificates, EICRs (Electrical Reports), and ensure the presence of smoke and carbon monoxide alarms.
